Terms of Service

The Services are intended for individuals aged 18 years and over. By using the Services, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

You are responsible for the security of your account. You are solely responsible for all activity that occurs under your account. If you become aware of any unauthorised use of your account, you must notify us immediately through the support channels available within the Services.

The Services use artificial intelligence models to generate design outputs, visualisations, recommendations, and related content ("Outputs") based on inputs provided by you. You acknowledge and agree that:

• All Outputs are generated at your direction, based on your inputs, through automated processes.
• Outputs are unpredictable and may be inaccurate, incomplete, unsuitable, or non-unique.
• Outputs do not constitute professional design, architectural, structural, engineering, legal, financial, or any other category of professional advice.
• You must not rely on Outputs as the sole basis for any decision, project, purchase, or action that carries material risk or cost.
• Versizo does not control, verify, or guarantee the accuracy, legality, or suitability of any Output.
• You are solely responsible for the inputs you provide, all Outputs generated from those inputs, any decisions made in reliance on Outputs, and any use, distribution, or commercialisation of Outputs.

To the maximum extent permitted by applicable law, Versizo is not responsible or liable for any Outputs or any loss, damage, claim, or consequence arising from their use. All Outputs are generated at your direction and are not attributable to Versizo.

You agree that you cannot and will not make any claim against Versizo, its owners, operators, officers, contractors, affiliates, agents, or technology providers arising from or in connection with any Output generated through the Services.

When you upload images, enter prompts, or submit any other content ("User Content"), you represent and warrant that:

• you own or have all necessary rights, licences, and permissions to submit and use that content;
• the content is lawful and does not infringe the intellectual property, privacy, or other rights of any person;
• the content does not contain identifiable individuals without their explicit, informed consent;
• the content does not include material that is defamatory, obscene, harassing, threatening, fraudulent, or otherwise prohibited by applicable law.

By submitting User Content, you grant Versizo a non-exclusive, worldwide, royalty-free licence to store, process, transmit, and use your User Content solely for the purpose of providing the Services to you. This licence does not extend to training AI models on your User Content.

Versizo has no obligation to monitor, review, or verify User Content. Versizo is not responsible for and expressly disclaims all liability in respect of any User Content. All User Content and Outputs are created at your direction and remain your sole responsibility.

You must not use the Services to:

• upload, submit, or generate content that is illegal, defamatory, obscene, harassing, or harmful;
• infringe any intellectual property right, privacy right, or other right of any third party;
• upload photographs or images of identifiable individuals without their explicit consent;
• reverse-engineer, decompile, or extract the underlying AI models or systems;
• damage, disable, overburden, or impair the platform;
• use automated tools, bots, or scripts to access the Services without authorisation;
• resell or sublicence access to the Services without written authorisation from Versizo;
• circumvent any subscription, billing, or access control mechanism;
• engage in fraudulent, deceptive, or unlawful activity.

Versizo reserves the right to remove any User Content and to suspend or terminate access for any breach of this section, at our sole discretion and without notice.

The Services, including all software, interfaces, designs, and content (excluding User Content), are owned by or licenced to Versizo. You must not copy, adapt, reproduce, or create derivative works from any part of the Services without our express written consent.

You retain ownership of your User Content. Outputs may be non-unique and similar to content produced for other users. Versizo makes no representation that any Output is original or that it does not infringe any third-party right. You are solely responsible for assessing the intellectual property status of any Output before use.

Access to certain features requires a paid subscription. Subscriptions renew automatically unless cancelled before the renewal date.

All payments are processed by third-party payment processors. Versizo does not store, process, or have access to your credit card or payment card details.

Versizo reserves the right to suspend access where payment is declined, overdue, or disputed. To the maximum extent permitted by law, all fees paid are non-refundable. Nothing in this clause excludes any rights you may have under the Australian Consumer Law.

Versizo may suspend, restrict, or terminate your account and access to the Services at any time, with or without notice, where we reasonably believe you have breached these Terms, your use poses a risk to the platform or third parties, or you have engaged in fraudulent or unlawful conduct.

You may delete your account at any time via your account settings. Deletion removes your account and personal data subject to applicable data retention obligations set out in our Privacy Policy.

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, Versizo expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty that the Services will be uninterrupted, error-free, or secure.

You use the Services entirely at your own risk.

To the maximum extent permitted by applicable law, Versizo, its owners, operators, officers, employees, contractors, affiliates, agents, and technology providers shall not be liable for any loss or damage of any kind, including:

• direct, indirect, incidental, special, consequential, or punitive damages;
• loss of profits, revenue, business, data, goodwill, or opportunity;
• loss arising from reliance on any Output;
• loss arising from User Content;
• loss from service interruptions or unavailability;
• loss from third-party service provider acts or omissions;
• loss from unauthorised access to or alteration of your data.

Where liability cannot be excluded by applicable law, our total aggregate liability to you shall not exceed the total fees paid by you in the three (3) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.

You agree to indemnify, defend, and hold harmless Versizo, its owners, operators, officers, employees, contractors, affiliates, agents, and technology providers from and against any and all claims, demands, actions, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or in connection with:

• your use of or access to the Services;
• any User Content you submit;
• any Output generated from your inputs;
• any use, reliance, distribution, or commercialisation of any Output;
• your breach of any provision of these Terms;
• your violation of any applicable law or third-party right.

This indemnification obligation survives termination of these Terms.

Severability: If any provision is found invalid or unenforceable, that provision shall be severed and the remaining provisions continue in full force.

Waiver: Failure to enforce any provision does not constitute a waiver of that right.

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Versizo and supersede all prior agreements.

Assignment: You may not assign your rights or obligations without Versizo's prior written consent. Versizo may assign its rights at any time.
